In a regularly scheduled meeting in Oakland Thursday, Cal/OSHA’s Occupational Safety & Health Standards Board voted down (3 to 2) an amendment to OSHA’s Bloodborne Pathogens standards (Title 8, Section 5193.1) clarifying regulations regarding condom use-In a regularly scheduled meeting in Oakland Thursday, Cal/OSHA’s Occupational Safety & Health Standards Board voted down (3 to 2) an amendment to OSHA’s Bloodborne Pathogens standards (Title 8, Section 5193.1) clarifying regulations regarding condom use in California’s adult film industry.

Despite the fact that the Cal/OSHA Occupational Safety & Health Standards Board failed to approve California’s workplace Bloodborne Pathogens standards (Section 5193.1) in order to better protect adult film workers regarding the use of condoms in adult films shot in California, the condom requirement remains, as Standards Board Chair Dave Thomas remarked in comments at the meeting: “I know a lot of you don’t want to realize it, you are already required to wear condoms. That’s already the law. That’s the way it is.”

“We are disappointed that the Occupational Safety & Health Standards Board failed to complete this years-long process, an action today that would have resulted in improved worker safety for adult film workers in California, but thank them for their work on this over the past six years,” said Michael Weinstein, president of AIDS Healthcare Foundation. “To be clear, condom use in adult film production in California—one of only two states in which adult film production is legal—already is required under California’s Bloodborne Pathogens standard. We are announcing today that we will immediately file a new petition with Ca/OSHA on this important health measure.”
