• Was this the guy that said he got the hiv from oral, because his throat was infected w/ chlamydia, making him more susceptible to catching it? Don't quote me on this, but I believe I read that somewhere about a 3 dollar bill mope.

• I think it goes without saying that if you are being honest, it doesn't matter how the question is phrased.

  • That's absurd. Polygraph tests require binomial replies and it is of paramount importance that the questions be carefully phrased and strictly confined to the issue under question. I don't know if he's telling the truth or not, but I didn't find his objection to inappropriately broad and irrelevant questions at all unreasonable.

    • Nick, you are correct, but it's one thing to narrow the question in terms of time -- it's quite another to limit the focus to a particular advertisement for escorting. It may be true that he never had sex with anyone off of RentBoy, but he admits in his second email that he was also escorting off of Craigslist. He also admits (contrary to his earlier claim to have had a monogamous off-camera relationship with Crystal), to have engaged in bareback swinging activity.

      To me, the most damning part is where Burts sought to narrow the question concerning whether or not he’d ever had bareback gay sex to whether or not he’d ever had bareback sex during a gay porn shoot. That seems to me to be pure misdirection.

      One common theory is that Burts had sex with a man who turned out to be HIV+ while in Florida to shoot (in September 2010). This person, the theory goes, may have also been involved in some way with production. There3fore, under this theory, if Burts had been asked (as he suggested):

      “Did you have bareback anal sex with guys in any of your shoots in the time frame you may have contracted HIV?”

      he would have been able to truthfully answer NO.

      Had the question been asked as: "Did you have ANY gay bareback sex during the 90 days preceding your October 8th AIM test?" he might not, under this theory, have been able to truthfully answer NO.

      • One more piece of the puzzle that supports this theory:

        Spiegler's fourth question (of the allotted four) was:

        "Is it possible you may have contracted HIV outside of the adult entertainment business?"

        In his final email to the polygraph examiner, Burts wrote: "I kept his last question as is.... Do I think it was possible to get HIV from outside of working in the industry... my answer would be NO, which would come out true... proving that I truly believe I got this from working in the industry. . . . Do I believe I got this in Florida while working on a gay shoot? Yes, I am willing to state that which will prove that I am correct."

        This supports the theory that Burts had sex with someone involved with one of his shoots -- but not necessarily a performer on camera. Note that Burts changed "in any of your shoots" to "while working on a gay shoot."

• Burts never mentioned having had any STI in his mouth. He speculated on how he contracted HIV at a December 8, 2010 press conference:

  "In a gay shoot when you do have condoms, that obviously does help reduce the chance of getting it, but there’s other aspects to a shoot than just the sex part: there’s oral, where there’s no condom involved – on gay or straight side there’s no condoms used when you’re doing the oral part. The condom comes on in a gay scene where the actual sex takes place. So during an oral scene, there’s no condom in place."

  "Not only that but, uhh, in porn we refer to it as the cum shot – the money shot – which is at the end. So, in gay porn, or in straight porn, you’re always gonna have the shot, you know, whether it’s on – usually on your chest, or your butt, or your back, you know. So there’s a chance that it could have come from the oral part, or also the cum shot, because when you get cum on you, you wipe it off with a rag, typically. So, -- and then you go and shower off."

  Note that Burts implied that oral sex is not sex.

  To have contracted HIV from oral sex, Burts likely would have had to have had recent oral surgery, or sores or other deep cuts in his mouth.

  In a telephone conference with reporters later that day, Burts altered or amended his theory, claiming that that he believed he might have contracted HIV after another performer ejaculated onto his back while Burts sat astride him. The semen, Burts speculated, leaked down the small of his back and up into his anus – either all on its own, or because Burts wiped himself with a rag.

  "The particular shoot where I think I may have contracted it was with Bang Bros. Productions in Florida, Venetian Productions, for one of their gay companies. When they did the cum shot, they pulled the condom off and the performer pretty much did the shot on my back rear end, and when that wiped off, I could have come in contact with that. So there's no knowing exactly where I got it, and like I said, condoms doesn't stop you from getting it, but like I said, it helps reduce the risk severely, and that's what's important."

  If oral HIV transmission is a long-shot, then Burts’ second hypothesis is the magic bullet theory of HIV infection.

    • The lengths to which Burts went to alter the polygraph questions cast serious doubt on his claim.

  • A correction -- I should have stated that Burts didn't ORIGINALLY mention having an STI in his mouth. In a June 2011 interview he told not one but TWO infection stories:

    He's talking about the Florida shoot on which he says he believes he contracted HIV:

    "I did a shoot where I was riding [a co-star] on top, like a reverse cowboy. He had the condom on and at the end pulled the condom off and did the cum shot all over my butt and near my anus. I know that semen came in contact with that area. This is just an idea of how I got it."

    In THE VERY NEXT SENTENCE he said this:

    "Either that or oral, because also the oral side of gay shoots is unprotected and it’s not like normal oral. You are doing 20 or 30 minutes of hardcore gagging. The cum shot was in my mouth. [It turns out that] I had gonorrhea in the throat during that shoot. When you have an active [sexually transmitted infection, or STI] it makes it a lot easier for you to contract HIV."

    I thought the cum shot was on his back? Now it was in his mouth, too?
