Proponents of Prop. 60, which requires visible condom use in any California-produced porn, say the initiative aims to promote safe sex practices and reduce transmission of sexually transmitted diseases. But the policy’s fine print allows any California resident who doesn’t see a condom in a film to personally sue any performer, producer, retailers or other worker who might benefit financially from a film.

“Imagine stalkers, overzealous fans, angry family members, and LGBTQ hate groups being able to obtain legal names and home addresses of people who are open about their sexuality and gender identity. Performers already face daily privacy invasions, harassment, and discrimination — a law giving a digital mob incentives to patrol sexual behavior should raise flags with all LGBTQ people everywhere,” wrote Eric Paul Leue of the Free Speech Coalition in an editorial for the Advocate  condemning Prop. 60.

Wiener, a San Francisco supervisor, echoed this sentiment, adding that the initiative could push the adult film industry out of California.

“Prop 60 is a sham. It won’t lead to a single additional condom being used in adult films and won’t do anything to improve public health. Instead, Prop 60 will simply push the adult film industry underground or out of state, thus making adult film performers less safe and less healthy,” Wiener said.

“Prop 60 isn’t based in science or public health,” Wiener added. “Rather, it’s based on outdated misinformation that condoms are the only way to prevent HIV.”

Bipartisan groups have urged voters to reject the initiative, including the California Democratic Party, the California Republican Party, the California Libertarian Party, San Francisco Young Democrats, San Francisco AIDS Foundation, Equality California, Transgender Law Center, the St. James Infirmary, ESPLERP, The Harvey Milk and the Alice B. Toklas Democratic Clubs, AIDS Project Los Angeles, Los Angeles LGBT Center, the Free Speech Coalition. the Adult Performer Advocacy Committee (APAC) and others.
