She has to prove some type of damages and she cant. Mercedes, however can prove damages. You just cant say that someone said something bad to me and I want $300.00. Assuming that Tara actually shows up, she will be sworn in. Can’t you then take that opportunity to ask her about everything she knows regarding pornwikileaks, its moderators, and its posters–UNDER OATH.
Couldn’t this ridiculous suit be an absolute gift?
My guess if she kept the amount low in order to entice we defendants to consider not showing up. Then she could get a default judgment and proclaim forever that she had been vindicated.

I do not know if you, or anyone, can join — no attorneys in Small Claims court so I have no expertise in the area. The way it works is, following service of a (properly filed) SC-100 “Plaintiffs Claim and Order”, defendants can file form SC-120/120A, Defendant’s Claim (a counter-claim).
What I would pay to be a fly on the wall. I cannot wait to hear the outcome of this.

I don’t know about CA, but here in MI any party to the suit can state that he/she wants a general civil trial and the small claims suit is transferred to general civil where a person may have an attorney. That is what I would do if I were Mercedes in this case, then have an attorney make Tara look like a loon! It would cost more than $300 but would be worth it. I see Monica is a defendant as well as well as another person by the initials of MKW. They should attempt to transfer the case to general civil as well and file a counterclaim. Yes, they need an attorney for this but it would probably be worth it as they can also make Tara look like she belongs in jail (even though jail is not an option for this case). Invite the prosecuting attorney to watch the proceedings if you dare, maybe Tara will hang herself and actually get prosecuted over this.
There’s no point, in my view, to spending any more money than necessary to demonstrate that Tara’s a loon. With the cache of evidence, including in-person testimony, we will have assembled, I am confident that fact will be made quite apparent to the court.
Tara will lose her case, we win our counterclaim(s), and Monica and Mercedes will be vindicated in the first PWL-related court proceeding.

I find it hilarious that even Tara apparently recognizes that her brain is so faulty that she only values her peace of mind at $300.
