Tamara Favazza, a woman from St. Louis won $5.77 million lawsuit against the makers of “Girls Gone Wild” DVDs after her exposed breast was filmed without her consent.
The unfortunate event for Favazza which turned out to give her a cool amount of fortune happened in 2005 when she was a 20-year-old college student. According to an earlier court testimony, she was having fun at the Rum Jungle club in St Louis, Missouri, when a contractor for “Girls Gone Wild” lifted her tank top, revealing her breasts. The incident was recorded and appeared in the “Girls Gone Wild Sorority Orgy” DVD series.
Tamara, now a 26-year-old wife and mother, filed a lawsuit in 2008 against Mantra Films Inc. and MRA Holdings LLC (makers of the said DVD) after learning from a friend of her husband that she was in the video. She claimed she did not give consent and the pornographic video company damaged her reputation and hurt her marriage.
“I was having fun until my top was pulled off. And now this thing is out there for the world to see forever,” Tamara was in tears while saying it to the Post-Dispatch in 2010.
The DVD makers claimed Favazza voluntarily danced for cameras and said that signs were posted at the bar saying camera crews for the company were shooting there. Tamara said she never saw the signs.
Associated Press reports that a St. Louis jury sided with the DVD makers in 2010, but a retrial was granted. Judge John J. Riley ordered a new trial three months after and wrote that it was clear in the video that Favazza was an “unwilling participant,” saying she is seen mouthing the word “no” as her shirt is pulled down, the report said.
On March 5, St. Louis Circuit Judge John Garvey issued his ruling and sided with Tamara Favazza, awarding her $5.77 million.
Mantra Films has asked for a retrial, but Jeffrey Medler, an attorney for Favazza, was quoted as saying that he will “vigorously oppose” any effort to overturn the ruling.
